1. GENERAL

By accessing, browsing, or placing an order on the Spectra Supply online store, you agree to be bound by these Terms of Service.

These Terms apply to all visitors, users, and customers of www.spectrasupply.co.za.

Spectra Supply operates in accordance with the laws of the Republic of South Africa, including applicable consumer protection, electronic transaction, privacy, and e-commerce laws.

3. PRODUCTS

Spectra Supply sells festival apparel, accessories, and related products through our online store.

Some products may be held as available stock, while others may be sold on a pre-sale, made-to-order, imported, or limited-batch basis.

We reserve the right to limit the sale of our products to any person, geographic region, or jurisdiction, where reasonably necessary.

All product descriptions, images, availability, pricing, and specifications are subject to change without notice.

We reserve the right to discontinue any product at any time.

4. PRODUCT IMAGES, COLOURS AND LIGHT-REACTIVE EFFECTS

We make reasonable efforts to display product colours, prints, and light-reactive effects as accurately as possible.

However, colours and effects may appear differently depending on screen settings, camera exposure, venue lighting, UV or colour-changing lights, and environmental conditions.

Product images are provided for guidance and may include supplier images, campaign images, or illustrative product visuals.

Minor variations in appearance, colour, print placement, or visual effect may occur and do not automatically constitute a defect.

5. PRICING

All prices are listed in South African Rand (ZAR).

Prices are inclusive of VAT where applicable.

Spectra Supply reserves the right to modify prices at any time without prior notice.

If a pricing error occurs, Spectra Supply may cancel the affected order and issue a full refund, or contact the customer to confirm whether they wish to proceed at the corrected price.

6. ORDERS AND PAYMENT

By placing an order, you confirm that all information provided is accurate, complete, and up to date.

You are responsible for ensuring that your contact details, delivery address, product selection, size, colour, and order details are correct before completing checkout.

Payment must be received before an order is processed, dispatched, or submitted for fulfilment, unless a deposit, balance payment, or alternative payment arrangement is clearly offered by Spectra Supply.

We reserve the right to refuse or cancel an order where reasonably necessary, including but not limited to suspected fraud, payment issues, incorrect pricing, supplier unavailability, stock errors, delivery restrictions, or misuse of the website.

Where an order is cancelled by Spectra Supply and payment has already been received, the customer will be refunded where applicable.

7. PRE-SALE, MADE-TO-ORDER AND LIMITED-BATCH ITEMS

Certain Spectra Supply products may be sold on a pre-sale, made-to-order, imported, or limited-batch basis.

This means the item may not be held as immediate local stock at the time of purchase.

Pre-sale and made-to-order items are processed according to the batch, campaign, or production timeline stated on the product page or campaign material.

Once the pre-sale batch closes, confirmed orders may be submitted to the supplier for production and/or import.

Estimated delivery timelines are provided in good faith and may be affected by supplier production schedules, international freight, customs clearance, courier delays, public holidays, incorrect customer details, or circumstances outside Spectra Supply’s control.

If Spectra Supply is unable to supply the ordered item, the customer will be offered an alternative item, store credit, or a refund.

8. DEPOSITS AND BALANCE PAYMENTS

Where a deposit option is offered, the deposit secures the customer’s place in the relevant pre-sale or limited-batch order.

The remaining balance will become payable before dispatch or before the item is released for delivery, as stated on the product page, invoice, or payment communication.

If the customer does not pay the outstanding balance by the communicated due date, Spectra Supply may cancel the order and release the reserved item for resale.

Any refund of the deposit will be assessed according to the cancellation terms, supplier commitments, payment processing fees, and costs already incurred, where permitted by law.

9. SHIPPING AND DELIVERY

Shipping and delivery are handled according to our Shipping Policy, which forms part of these Terms.

Delivery timelines displayed on the website are estimates and are not guaranteed unless expressly stated in writing.

For pre-sale or made-to-order items, the estimated delivery period is calculated from the batch closing date or supplier processing date, not necessarily from the date the customer places the order.

Spectra Supply is not responsible for delays caused by incorrect customer information, courier disruptions, customs inspections, supplier delays, public holidays, force majeure events, or circumstances outside our reasonable control.

10. IMPORT DUTIES, TAXES AND LANDED COSTS

Unless otherwise stated, prices displayed on the Spectra Supply website include the selling price payable by South African customers for orders placed through our South African store.

Spectra Supply is responsible for supplier procurement, import processing, customs clearance, and local fulfilment for confirmed South African customer orders, unless otherwise clearly stated before purchase.

Customers will not be asked to separately pay import duties or import VAT on orders fulfilled by Spectra Supply unless this is clearly disclosed before purchase.

11. EXCHANGES, RETURNS AND CANCELLATIONS

All exchanges, returns, cancellations, and refund requests are subject to our Return & Exchange Policy, which forms part of these Terms.

Certain hygiene-sensitive items, made-to-order items, personalised items, opened items, worn items, used items, or final-sale items may not be eligible for exchange or return for change-of-mind, incorrect sizing selected by the customer, or personal preference.

This does not limit any rights the customer may have under applicable South African consumer protection laws where an item is defective, damaged, incorrectly supplied, or cannot be supplied.

12. ONLINE PURCHASE COOLING-OFF RIGHTS

Where applicable under South African electronic transaction laws, customers may have the right to cancel certain online purchases within 7 days after receiving the goods.

This right may not apply to all products, including certain made-to-order, personalised, hygiene-sensitive, opened, worn, or used items.

Where a valid cooling-off cancellation applies, the customer is responsible for the direct cost of returning the goods, and the goods must be returned unused, unworn, undamaged, with original tags attached and in original packaging.

13. CUSTOMER RESPONSIBILITY

Customers are responsible for:

- Providing accurate order, contact, and delivery information
- Reviewing product descriptions before purchasing
- Reviewing size charts before selecting a size
- Understanding whether an item is in stock, pre-sale, made-to-order, imported, or limited-batch
- Reading the applicable Return & Exchange Policy, Shipping Policy, and Pre-Sale Policy before placing an order

14. INTELLECTUAL PROPERTY

All content on this website, including logos, graphics, text, layout, product imagery, brand elements, and design elements, is owned by or licensed to Spectra Supply, its suppliers, brand partners, or licensors.

This content may not be copied, reproduced, distributed, modified, or used without prior written permission from the rightful owner.

Nothing on this website grants any customer or visitor rights to use Spectra Supply’s brand name, logo, product imagery, supplier imagery, or intellectual property.

15. THIRD-PARTY PRODUCTS, SUPPLIERS AND BRAND PARTNERS

Some products, designs, images, or brand assets displayed on the website may originate from Spectra Supply’s suppliers, brand partners, or licensed product sources.

Spectra Supply makes reasonable efforts to ensure that product information is accurate, but supplier specifications, availability, designs, pricing, and production timelines may change.

16. PRIVACY

Your personal information is collected, used, stored, and protected in accordance with our Privacy Policy, which forms part of these Terms.

We do not sell your personal information to third parties.

We may share personal information with trusted service providers where necessary to process payments, fulfil orders, arrange delivery, provide customer support, comply with legal obligations, or operate the store.

You agree not to misuse the website, attempt unauthorised access, interfere with website functionality, submit false information, abuse promotions, commit fraud, or use the website for any unlawful purpose.

Spectra Supply reserves the right to restrict access, cancel orders, or take appropriate action where website misuse, fraud, or unlawful conduct is suspected.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Spectra Supply will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website, products, or services.

Where liability cannot legally be excluded, Spectra Supply’s liability will be limited to the value of the order placed by the customer, where permitted by law.

Nothing in these Terms limits or excludes any rights or remedies that a customer may have under applicable South African consumer protection laws.

19. FORCE MAJEURE

Spectra Supply will not be liable for failure or delay in performing any obligation where such failure or delay is caused by events beyond our reasonable control.

This may include, but is not limited to, supplier delays, freight disruptions, customs delays, courier disruptions, natural disasters, strikes, power failures, system failures, pandemics, government restrictions, or other force majeure events.

20. CHANGES TO THESE TERMS

We reserve the right to update or amend these Terms of Service from time to time.

Any changes will be posted on this page and will take effect from the date of posting, unless otherwise stated.

Continued use of the website after changes are posted means you accept the updated Terms.
